A proposed Settlement has been reached in a class action lawsuit known as Chacon et al. v. Nebraska Medicine, Case No. 8:21-cv-00070-RFR-CRZ, United States District Court for the District of Nebraska.
This lawsuit arises out of a network intrusion which occurred between August 27, 2020 and September 20, 2020 that was discovered by Nebraska Medicine and/or the University of Nebraska Medical Center (“UNMC”) on or about September 20, 2020 (the “Data Incident”). The information that may have been accessed in the Data Incident includes names, addresses, dates of birth, health insurance information, medical record numbers, and/or clinical information (including physician notes, laboratory results, imaging, diagnosis information, treatment information, and/or prescription information) (collectively, called “PII”) and, in some instances, Social Security and/or driver’s license numbers. Defendant disagrees with Plaintiffs’ claims.
All Settlement Class Members can receive the following benefits from the Settlement: (1) up to $300 for documented out-of-pocket expenses, (2) reimbursement for up to six (6) hours of lost time spent dealing with the Data Incident ($20 per hour), and (3) reimbursement for extraordinary losses up to $3,000 for documented expenses. Defendant also agrees to update business practices and enhance security.
Credit Monitoring Subclass Members, which include those who had their Social Security and/or driver’s license numbers potentially accessed, will also automatically receive one (1) year of additional credit monitoring services without the need to make any affirmative claim. This credit monitoring is in addition to any credit monitoring previously offered by Nebraska Medicine and/or UNMC following the Data Incident.
You are included in this Settlement as a Class Member if you were mailed notification that indicated your PII was potentially accessed as a result of the Data Incident.
You are included in this Settlement as a Credit Monitoring Subclass Member if you were mailed notification that indicated your Social Security and/or driver’s license number was potentially accessed as a result of the Data Incident.
If you are a Settlement Class Member, your legal rights are affected regardless of whether you do or do not act. Read the Notice carefully.
YOUR LEGAL RIGHTS & OPTIONS IN THIS SETTLEMENT
Submit a Claim and/or Receive Credit Monitoring
You must submit a Valid Claim to get money from this Settlement.
Claim Forms must be submitted online by October 4, 2021 by 11:59 p.m. Central Timeor, if mailed, postmarked no later than October 4, 2021.
You do not have to submit a Claim to get Credit Monitoring if you are entitled to it as a Credit Monitoring Subclass Member.
If you are a Credit Monitoring Subclass Member, you do not need to make a claim for additional monitoring. If you previously signed up for monitoring, your monitoring will be automatically extended for one (1) additional year. If you did not previously sign up for monitoring, Experian will be contacting you directly to make you an offer of one (1) free year of credit monitoring.
If you do nothing, you remain in the Settlement.
You give up your rights to sue and you will not get any money.
Get out of the Settlement. Get no money. Keep your rights.
This is the only option that allows you to keep your right to sue about the claims in this lawsuit. You will not get any money from the Settlement.
Your request to exclude yourself must be postmarked no later than September 7, 2021.

Stay in the Settlement but tell the Court why you think the Settlement should not be approved.

The Final Fairness Hearing is scheduled for September 15, 2021.
